TERMS & CONDITIONS

In these terms and conditions, “THE LIGHTHOUSE” or “company” or “site” or “I” or “us” or “we” refers to a private company based out of the United States doing business on https://www.thelighthousespark.com. “You” or “Client” refers to the visitor of the site and/or purchaser of any goods or services from THE LIGHTHOUSE.

Access and use of https://www.thelighthousespark.com, including all materials/content provided herein and all services provided by THE LIGHTHOUSE, is subject to the following Terms and Conditions. As such, these terms and conditions are applicable to all site visitors, customers, and all other users on this site.

By using this site or our services, you agree to these terms and conditions, without modification, and acknowledge having read them.

By accessing or using this site (THE LIGHTHOUSE; https://www.thelighthousespark.com) you acknowledge that the use of this site and any of the services provided are intended for those aged 18 years of age or older. Additionally, you acknowledge that by utilizing this site and/or the services it provides, you are certifying that you are at least 18 years of age and have the power and authority to enter into these terms and conditions. Anyone under the age of 18 is expressly prohibited from using this site and/or its services.

Full payment is required for all goods and services before they are provided to the client. NO EXCEPTIONS. All goods and services are charged in US dollars. Payments will be accepted via credit or debit card only and as such you give us permission to automatically charge your credit or debit card for all fees and charges due and payable to THE LIGHTHOUSE, without any additional authorization, for which you will receive an electronic receipt via the email address you provide. In addition, you also agree that THE LIGHTHOUSE is authorized to securely share any payment information and related instructions required to process your payment with any and all of its third-party payment service providers (e.g., payment processing services and related services).

Given the energetic and intuitive nature of the services provided by THE LIGHTHOUSE, you understand and acknowledge that the services offered on this site are subject to our acceptance of your order or requests for services. No order or request for service is considered accepted until payment in full has been processed. Even so, we reserve the right to refuse or terminate service at any time and for any reason, without the obligation of providing a reason for doing so. Please understand, that in the event a service must be canceled by THE LIGHTHOUSE after payment has already been processed AND before service has begun, a refund will be issued for the full payment amount, unless the client agrees to reschedule or accept their order or service at a later date. Please see the terms for refunds as listed below:

THE LIGHTHOUSE reserves the right to accept or refuse any payment made in any form and where applicable, payments will be refunded according to its established refund policy.

There are few instances where refunds will be provided. Refund policies are as follows:

For Online Bookings (readings performed live, online, via zoom): Complete refunds will only be provided with cancellations made at least 48 hours in advance of the scheduled service. Any cancellations made with less than the required 48 hours advance notice will only have HALF of the payment refunded. And no shows (the client will be deemed a no show after 15 minutes) will NOT be refunded. 
For Purchased Readings: Once payment is received, there will be NO REFUNDS on these services for ANY reason.  
Completed Services: There will be absolutely NO REFUNDS offered on any completed (or partially completed) services for ANY reason up to and including the client deeming that they do not like or immediately (or ever) resonate with the reading. 
Cancellations initiated by THE LIGHTHOUSE: In the event that it is necessary for THE LIGHTHOUSE to cancel any services (online booking appointments, purchased readings, and/or any other services offered now or in the future) before work on those services begins, we will do our best to communicate to the client the cancellation with as much advance notice as is possible. Should this happen we will work with the client to reschedule their booking or accommodate their order or request for service as soon as is possible, or if the client prefers, they will be provided with a complete refund.

When you opt to purchase any goods or services from THE LIGHTHOUSE, whether on this site or by other legitimate means (e.g., via our use of a point of sale system for purchases made in person, over the phone, or other means), you do so with the understanding of and adherence to the terms and conditions as outlined herein. You affirm that you will honor and be financially responsible for any and all purchases made by you, or by anyone else, on your behalf. You understand and affirm that with respect to purchased readings, you can typically expect to receive your reading(s) within 3-5 business days after your payment is received. Due to the energetic and intuitive nature of the service being provided to you, THE LIGHTHOUSE cannot guarantee that there will not be any delay in receiving your reading, nor will THE LIGHTHOUSE provide any refunds for any delays in delivery. Delays are not equivalent to cancellations. As stated previously, if for some reason I must cancel your purchase or service before work can be done, I will offer you a complete refund or other arrangements.

By utilizing this site or its services you also acknowledge the following disclaimer: THE LIGHTHOUSE is not responsible for how you utilize this website, its services, or the information provided therein; nor is the company responsible for the choices and/or actions you choose to make because of any perceived influence of the aforementioned website, its services, or any information provided therein. By participating in the services provided by THE LIGHTHOUSE (e.g., booking/purchasing readings, using this site, reading blogs and/or email communications, or otherwise participating in or engaging with any content of THE LIGHTHOUSE on this site or its social media accounts) you acknowledge that I am not a licensed medical or mental health practitioner, nor am I certified as legal counsel and therefore any communication between myself and the client must not be used as a substitute for those things. If you need medical, psychological, legal, business, or any other specialized advice, care, or services, please seek out those respective professionals as tarot cannot be used as a substitute for professional expertise. You understand that you and you alone are solely responsible for your life and as such you must use your own judgment and intelligence when contemplating the information provided via the services provided by THE LIGHTHOUSE. You understand that by utilizing this site and any of the goods and/or services provided herein that you are doing so for entertainment purposes only and that all theories, ideas, opinions, or so-called “guidance” are simply opinions and not to be taken as absolute fact. THE LIGHTHOUSE makes no guarantees as to the outcome of tarot or other psychic efforts and/or recommendations on this website/blog/email/comments (both on this website and across social media profiles) and as such my comments represent only my opinions.

You agree that in the event that you choose to provide a review or testimonial, by any means (email, text, contact and/or testimonial form, social media commentary or engagement, etc), you are giving consent for that review or testimonial to be used by THE LIGHTHOUSE on its website and/or any of its social media accounts and that that review or testimonial may be minimally edited by us for clarity and emphasis and will be attributed to you using your first name and the first initial of your last name (i.e., Jane Doe would be displayed at Jane D.). You also affirm that you understand that in the event that you would prefer to use a pseudonym in association with your review or testimonial, or withdraw consent completely you must do so in writing, via an email sent to info@thelighthousespark.com

YOU AGREE THAT UNDER NO CIRCUMSTANCE SHALL I/THE LIGHTHOUSE BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY, OR ANY OTHER DAMAGES ARISING OUT OF YOUR USE OF THIS SITE OR ITS SERVICES.
ADDITIONALLY, THE LIGHTHOUSE IS NOT LIABLE FOR DAMAGES IN CONNECTION WITH (I) ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, DENIAL OF SERVICE, ATTACK, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, OR LINE OR SYSTEM FAILURE; (II) LOSS OF REVENUE, ANTICIPATED PROFITS, BUSINESS, SAVINGS, GOODWILL OR DATA; AND (III) THIRD PARTY THEFT OF, DESTRUCTION OF, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF YOUR INFORMATION OR PROPERTY, REGARDLESS OF OUR NEGLIGENCE, GROSS NEGLIGENCE, FAILURE OF AN ESSENTIAL PURPOSE AND WHETHER SUCH LIABILITY ARISES IN NEGLIGENCE, CONTRACT, TORT, OR ANY OTHER THEORY OF LEGAL LIABILITY, THE FOREGOING APPLIES EVEN IF THE LIGHTHOUSE HAS BEEN ADVISED OF THE POSSIBILITY OF OR COULD HAVE FORESEEN THE DAMAGES. IN THOSE STATES THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR THE DAMAGES, OUR LIABILITY IS LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY LAW. IN NO EVENT SHALL THE LIGHTHOUSE’S CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL PURCHASE PRICE OF THE SERVICE YOU HAVE PURCHASED FROM THE LIGHTHOUSE, AND IF NO PURCHASE HAS BEEN MADE BY YOU THE LIGHTHOUSE’S CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED $100.

THE LIGHTHOUSE may, at any time, amend these Terms and Conditions. These amendments will be effective immediately upon notice to you via our posting of the new/amended terms and conditions on this site. Any use of this site or its services by you after this notice affirms that you accept these amendments. We reserve the right to update any portion of our site and its services, including these terms and conditions, at any time. As such, we will post the most recent version to this site and list the effective date(s) on the pages of our terms and conditions.
